Crise anglophone au Cameroun : la nationalité des leaders séparatistes arrêtés débattue au tribunal

Jeune Afrique | Les leaders de l’autoproclamée république d’Ambazonie arrêtés au Nigeria le 5 janvier 2018 ont pris part à la deuxième audience dans l’affaire qui les oppose à l’État du Cameroun. Leur procès, marqué par un débat houleux sur leur nationalité, a été renvoyé au 7 février.

La tension est montée d’un cran le jeudi 10 janvier au tribunal militaire de Yaoundé, lors de la deuxième audience publique dans l’affaire Sisiku Julius Ayuk Tabe et les autres cadres du mouvement séparatiste contre le ministère public du Cameroun. À l’origine de cette ambiance électrique qui a plusieurs fois tourné aux altercations entre avocats, un débat sur la nationalité des accusés. Car lors de leur présentation à la cour, ils ont tous renié la citoyenneté camerounaise.

« Je ne suis pas Camerounais, je suis un citoyen de l’ancien Southern Cameroons britannique, également connu sous le nom d’ “Ambazonie” », a ainsi affirmé Sisiku Julius Ayuk Tabe, le président de l’autoproclamée « république d’Ambazonie », ouvrant le bal à ses neuf coaccusés qui lui ont tous emboîté le pas. Une position ferme, qui a amené l’important collège de la défense – composé de près d’une cinquantaine d’avocats dont trois anciens bâtonniers du barreau – à soulever une objection préliminaire.

Sisiku Julius Ayuk Tabe avait été arrêté le 5 janvier dans un hôtel d’Abuja en compagnie de neuf autres cadres de son mouvement, alors qu’il présidait une réunion consacrée à la « crise des réfugiés » issus du Cameroun anglophone au Nigeria.

Demande de suspension d’audience

La défense des leaders ambazoniens a ainsi demandé une suspension d’audience, afin d’établir la nationalité des accusés. « Le tribunal militaire n’est pas compétent pour juger ces personnes en l’état, en raison des questions que soulève leur nationalité », a lancé Me Patrick Yong, évoquant l’article 41 du code de la nationalité camerounaise qui déclare les juridictions civiles compétentes pour ces cas. « Il faut déterminer de quelles nationalités sont les accusés avant de les juger. Ils doivent être renvoyés vers le Nigeria, leur lieu de résidence, pour traiter de cette affaire conformément à l’article 42 du code de la nationalité », a renchéri Me Eya Peter.

Pour la partie civile cependant, des documents attestant que les accusés sont bel et bien camerounais existent. « Nous disposons des preuves qu’ils sont Camerounais. Nous avons leurs cartes nationales d’identité et leurs passeports. Certains parmi eux ont été des fonctionnaires au Cameroun donc des employés de l’État, et vous nous dites qu’ils ne sont pas Camerounais ? », a interjeté le commissaire du gouvernement.

« Ni le passeport ni la carte nationale d’identité ne prouve la nationalité de quelqu’un, seul le certificat de nationalité fait foi, dit la loi, or vous n’avez pas présenté ces documents ici », a immédiatement répliqué Me Akere Muna.

Audience renvoyée au 7 février

À 19 h 25, après plusieurs heures d’échanges d’arguments, le président du tribunal, le colonel Mem Michel, a été contraint d’ordonner une pause, afin de calmer les esprits qui commençaient à s’échauffer. À la reprise, le statut de réfugiés de certains des accusés a également été évoqué.

« Le commissaire du gouvernement nous demande de produire des documents qui prouvent que nous ne sommes pas Camerounais et que nous étions réfugiés au Nigeria. Depuis le 5 janvier que nous avons été kidnappés à Abuja, nos pièces ont été saisies et nous sommes gardés au secret sans contact avec qui que ce soit. Nous avons les preuves que nous sommes réfugiés, donnez-nous juste la possibilité de les produire », a plaidé Elia Eyambe Ebai, l’un des dix accusés du jour.

Vers 21 h 30, après une énième concertation avec ses assesseurs, le président du tribunal a finalement reporté l’audience au 7 février, afin de donner du temps aux deux parties de présenter les pièces prouvant la nationalité camerounaise des accusés d’une part, et leur statut de réfugiés d’autre part.

La garde présidentielle nigériane impliquée ?

L’audience du 10 janvier a également été l’occasion d’en savoir davantage sur les conditions d’arrestation de Sisiku Julius Ayuk Tabe et de ses coaccusés au Nigeria. Au cours des débats, l’avocat nigérian Abdoul Orock a ainsi révélé que des sources au département de la Sécurité de l’État nigérian lui ont confié que l’opération avait été menée par les soldats de la garde présidentielle nigériane, sans l’intervention des autres services de sécurité de l’État nigérian.

Selon le même avocat, prés de 210 000 Camerounais seraient actuellement réfugiés dans son pays, parmi lesquels seuls 30 000 d’entre eux ont pu être enregistrés par les organisations de l’ONU en charge des réfugiés.

Too often persons passing for street-smart find themselves in a court of law where their supposed smartness is reduced to zero. And being a self-proclaimed judge over others is one thing, being wise defense attorney to wrestle one’s way out of difficult litigation is something else.

    For a very long time Cameroon continued to use foreign coaches for the Indomitable Lions only because the selection of a national would usher in ethnocentric warfare. And so it has been the trend to use foreigners. But when Ndedi Eyango, a full-blooded Cameroonian returned from his own search for the green pastures, ran for and was voted president of SOCAM(Societe Camerounaise des Musiciens) he was rejected on the pretext that he was not Cameroonian but American.
    So why the ambivalence in accepting Julius Ayuk Tabe’s declaration of not being Cameroonian?

    • What is interesting there? How did Cameroon win the Bakassi case? Those fellows are trying to play smart at their own peril… but all what the tribunal needs to do is condemn them to death and actually prepare to execute the sentence. Then they will start weeping about why they didn’t opt for an apology and beg for clemency. A lot of people do not know anything about the powers of the state.   10. I don`t care what nationality these people arrogate themselves. As far as I know, I have not mandated anybody to speak on my behalf, so gov`t can do with them, whatever it pleases.

    Also, people comparing Cameroon to South Africa, are making a mockery of real apartheid. Only a few weeks ago, there were racial confrontations in Cape Town, when a group of black South Africans were refused access to a local beach, bywhite security guards. I wait to see the day Anglophones are denied access to beaches in Kribi.

      In Cameroon the Francophone army removes all Anglophone passengers from intercity buses and mandates them to sing the French Cameroon anthem.

      Anglophones are deliberately denied any position of power by policies of the Francophone predominant government.

Camroon was a German protectorate,or called it German external territory.HE Ayuk Tabe is talking about post colonial Africa.Of course,after France and Britain divided Cameroon,SC became a country,with a constitution and an executive leader,elected by the people of SC,same as their LRC’s counterpart.For Biya to come and make Ayuk Tabe a citizen of LRC in 1984 was the biggest blunder in the history of politics.

  14. @General Kunde Whether there is a country called Ambazonia or not,is not LRC’s business.Leave that to the UN to judge.First of all,HE Ayuk Tabe and co were not arrested on CMR soil.Why should CMR question their nationalites? How did they arrive CMR from Nigeria? Did they arrive CMR legally? Were their CMRnian ”passports” stamped at the port of entry? Where is the document from Abuja high court to proof that they were legally extradited,since they are citizens of LRC? We need answers to all this questions and more.For now,send them back to Nigeria.The military court in Y’de does not have the competence to determine people’s nationalities.Nationalities are established in a civil court,not courts martials.Send them back to Nigeria high court Abuja,for their nationality to be established.

    needed a pass – `laissez – passez? The Mungo bridge, being a natural barrier to this day.
    Killing of blacks in South Africa to this day of post apatheid, is eloquent proof for historical
    fact, that as from now onwards, both parties – Ambazonians / lrc, can not live together
    as one, as some crazy folks are thinking. For only this reason, there is enough proof beyong
    the reasonable doubt, that Ambazonians must go. There is no need, to live to fight the other
    day, by forcing any living together.
    LRC, can not burn down our whole villages, rape our sisters, kill with impunity, call us Biafra
    etc, etc etc etc and a union, is feasible. Not at all. So let`s donate the cash for our freedom.

    Black and coloured South Africans made up over 85% of the population, yet owned less than 15% of productive land; they never made the upper echelons of gov`t; were relegated to Bantustans…

    Anglophone Cameroonians onlly make up a quarter of the population, yet want 100% of the attention.

    You say, “Anglophones are deliberately denied any positions of power…”. You must be kidding. Should we pretend, the current and past Prime Ministers, are not anglophone? You`ve never met a anglophone police commisioner, director, governor, minister…?

    There`s a difference between escapism and problem-solving. Corruption, greed, slopiness… does not always equate to bias.

    This whole issue is built on a hypothetical sense of cultural superiority.
